El pasado 21 de abril la Agencia Nacional de Licencias Ambientales ANLA emitió un edicto mediante el cual citó la convocatoria de una audiencia pública virtual dentro del trámite de aprobación de modificación del plan de Manejo Ambiental prerrequisito para el regreso de las aspersiones con Glifosato, que sería el próximo 27 de mayo de 2020 .
Ante esto, más de 90 organizaciones sociales, ambientalistas y de derechos humanos, y académicos exigieron a través de una tutela que se suspenda dicha audiencia y que se amparen los derechos al acceso a la información, la participación efectiva en la toma de decisiones ambientales, la consulta previa y el consentimiento previo, libre e informado, el principio de transparencia y el debido proceso.
“Rechazamos no sólo el retorno de las aspersiones sino la ilegalidad con la cual pretenden realizar las audiencias públicas por parte de la ANLA. Conocemos que las realidades territoriales no dan para una participación efectiva y eficaz como la que merece este tema”, manifestó Rosa María Mateus, abogada del Colectivo de Abogados José Alvear Restrepo.
Las organizaciones denunciaron que, el Gobierno Nacional pretende imponer una medida que catalogan como arbitraria, restrictiva, desproporcionada, ilegítima e ilegal y criticaron el hecho de que, excusándose en la situación de emergencia de salud pública que vive el país por el COVID-19, se desconozca que la audiencia pública ambiental de carácter “virtual” no se encuentra autorizada por la ley.
A través dela tutela, solicitan al Juzgado que decrete una medida provisional -previa al fallo de tutela- que suspenda la mencionada audiencia pública virtual hasta tanto no se den las condiciones de salud pública y de participación adecuadas para la realización de este trámite.
Es importante recordar que, mediante la Sentencia T- 236 de 2017 y el Auto 387 de 2019, la Corte Constitucional dictó una serie de órdenes que debían cumplirse en caso de querer retomar las aspersiones aéreas con Glifosato, suspendidas por múltiples evidencias de su ineficacia en la lucha contra las drogas, daños en la salud y el ambiente.
La Corte señaló en esa decisión que la participación efectiva es aquella que: “exige que las autoridades públicas consideren a fondo las recomendaciones de las personas que participan en los espacios deliberativos, expresen las razones por las cuales se decide acoger o no dichas recomendaciones, y se aseguren de que dichas razones son comprendidas por las comunidades y personas afectadas. La participación, en este sentido, debe ser siempre un proceso de doble vía.”.
Es de resaltar que el regreso de las aspersiones con glifosato afectaría de manera directa a 104 municipios del país distribuidos en 14 departamentos que corresponden principalmente a territorios rurales habitados por comunidades campesinas, indígenas y afro en los que se proyecta reanudar una actividad que en el pasado fue suspendida por las múltiples evidencias de su ineficacia en la lucha contra las drogas y por su grave peligrosidad para el ambiente y la salud humana.
